These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Client", "you", or "your") and Kwaipmkwai Travel & Tours ("Kwaipmkwai", "we", "us", or "our").

By accessing our website, submitting an enquiry, accepting a proposal, paying a deposit, or travelling on an itinerary arranged by us, you agree to be bound by these Terms together with any booking confirmation, proposal, invoice, or service schedule we issue to you.

If you are booking on behalf of other travellers, you confirm that you have authority to accept these Terms on their behalf and to provide their personal information for travel arrangements.

Kwaipmkwai is a travel agency based in Tanzania. We design, coordinate, and book travel experiences including, but not limited to, safaris, lodge stays, beach holidays, Kilimanjaro-related travel, cultural tours, transfers, guided activities, and custom itineraries.

Unless expressly stated in writing, we act as an agent coordinating services provided by independent third-party suppliers such as hotels, lodges, airlines, vehicle operators, activity providers, and guides. Those suppliers operate under their own terms, safety standards, and licensing requirements.

Information on our website is provided for general inspiration and planning. It does not constitute a binding offer until confirmed in a written proposal or booking confirmation.

Proposals are based on availability, seasonality, routing, and supplier rates at the time of preparation. Prices, accommodation options, and activity schedules may change until a booking is confirmed and any required deposit is received.

We reserve the right to decline an enquiry where we believe we cannot meet your requirements safely, ethically, legally, or operationally.

A booking is considered confirmed only when you have accepted our written proposal or confirmation and paid any deposit or amount specified in that document.

Deposits are generally non-refundable once supplier reservations have been made on your behalf, unless otherwise stated in your booking documents or required by applicable law.

We may require full payment by a specified deadline before travel. Failure to pay on time may result in cancellation of arrangements and forfeiture of amounts already paid, subject to supplier policies.

Quoted prices are typically shown in United States Dollars (USD) unless otherwise stated. Payment methods, currencies accepted, and bank charges will be specified in your invoice or booking confirmation.

• Prices may include or exclude park fees, government taxes, visas, tips, beverages, optional activities, travel insurance, international flights, and personal expenses unless clearly stated.
• If supplier rates, taxes, park fees, fuel costs, or exchange rates change materially after booking confirmation but before travel, we will inform you of any price adjustment required to maintain the confirmed itinerary.
• You are responsible for any bank transfer fees, card processing charges, or currency conversion costs unless expressly agreed otherwise in writing.

Travel arrangements are subject to supplier cancellation policies, which often impose penalties as the travel date approaches. Your booking confirmation will outline the cancellation terms applicable to your itinerary.

You are responsible for ensuring that all travellers hold valid passports, visas, vaccinations, permits, and any other documentation required for entry into Tanzania and any transit countries.

We strongly recommend comprehensive travel insurance covering medical treatment, emergency evacuation, trip cancellation, interruption, personal belongings, and activity-specific risks relevant to safari, mountain, marine, or adventure travel.

You must disclose any medical conditions, mobility requirements, dietary needs, allergies, or other factors that may affect travel planning or safety. Failure to provide accurate information may affect our ability to deliver services and may limit our liability.

You agree to follow the instructions of guides, drivers, lodge staff, park rangers, and Kwaipmkwai representatives regarding safety, wildlife viewing distances, conservation rules, and local customs.

• Respect wildlife, habitats, communities, cultural sites, and national park regulations at all times.
• Avoid behaviour that endangers yourself, other guests, staff, animals, or the environment.
• Settle personal expenses not included in your confirmed itinerary directly with suppliers where required.
• Ensure minors in your care are supervised appropriately throughout the journey.

Safari and adventure travel involve variables including weather, road conditions, animal movements, flight delays, park closures, and local events. Reasonable adjustments to timing, routing, or activity order may be made to protect safety and experience quality.

We are not liable for failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, epidemics, civil unrest, strikes, government actions, telecommunications failures, or extreme weather.

To the fullest extent permitted by applicable law, our total liability arising out of or in connection with any booking or travel services shall be limited to the amount paid by you to Kwaipmkwai for the affected services, excluding insurance premiums, international airfares booked independently, and amounts paid directly to third parties.

We are not liable for indirect, incidental, special, or consequential losses such as loss of enjoyment, lost income, or missed connections, except where such limitation is prohibited by law.

Where services are performed by independent suppliers, those suppliers are responsible for their own acts and omissions. We will assist with reasonable communication and coordination but do not guarantee supplier performance beyond our role as agent.

If you experience a service issue during your trip, please notify your guide, lodge, or our team as soon as possible so we can attempt to resolve the matter promptly.

Formal complaints should be submitted in writing to booking@kwaipmkwai.co.tz within 30 days of the end of travel, including booking reference, dates, and supporting details. We will review complaints in good faith and respond within a reasonable timeframe.

If a dispute cannot be resolved amicably, the parties agree to attempt mediation or other good-faith resolution before pursuing formal proceedings, where practical.

All content on our website, including text, photography, branding, layout, and design, is owned by or licensed to Kwaipmkwai and protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, or commercially exploit our content without prior written permission.

These Terms are governed by the laws of the United Republic of Tanzania, without regard to conflict-of-law principles.

Subject to any mandatory consumer protections in your home jurisdiction, you agree that the courts of Tanzania shall have exclusive jurisdiction over disputes arising from these Terms or services booked through Kwaipmkwai, unless otherwise required by applicable law.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.

These Terms, together with your booking confirmation and any written amendments signed or accepted by both parties, constitute the entire agreement relating to the subject matter herein.
